Background Check – Reliability Assessment

1. Legal Basis

Under the legal framework of the Slovak Republic, the background check of a person consists of two components:

  • Reliability Assessment, which is performed by the Transport Authority, and
  • Criminal Records Check from all states of residence, which is performed by the employer of a person.

The Reliability Assessment is performed by Transport Authority in accordance with point 11.1. of the Annex to Commission Implementing Regulation (EU) 2015/1998 and paragraph 34a (4) and (5) of Act No. 143/1998 Coll. on Civil Aviation (Aviation Act), as amended.

The Criminal Records Check is performed by the employer of the applicant in accordance with point 11.1. of the Annex to Commission Implementing Regulation (EU) 2015/1998and paragraph 34a(3) of Aviation Act. Furthermore, the employer is responsible for verifying the completeness and correctness of all information provided in the application.

2. What type of background check is required?

There are two types of background checks: standard and enhanced. The type of background check required depends on the applicant’s assigned duties and responsibilities, as specified in Chapter 11 of Implementing Regulation (EU) 2015/1998.

An enhanced background check shall be conducted when the applicant is required to hold an airport identification card for access to a security restricted area or a crew identification card.

3. When to submit an application?

It is important to note that the process of obtaining a reliability assessment by the Transport Authority usually takes two months. This is particularly important to keep in mind in the case of obtaining a recurrent background check, which is conducted:

  • every 12 months for an enhanced background check, or
  • every 3 years for a standard background check.

4. What documents are required for the application?

Applicants who are employed by a Slovak employer

The application for the Reliability Assessment requires the submission of the following documentation:

  1. application,
  2. record of employment, education and any time gaps
  3. copy of passport or Slovak Identity Card
  4. proof of payment of the administration fee

Applicants who are employed by a foreign entity

The application for the Reliability Assessment requires the submission of the following documentation:

  1. application,
  2. record of employment, education and any time gaps
  3. copy of passport or Slovak Identity Card
  4. proof of payment of the administration fee
  5. officially extract from the Business Register

If the applicant is an employee of a foreign entity that is not registered in the Business Register of the Slovak Republic, an officially extract from the Business Register of the country in which the entity resides must be submitted with the application.

5. What is the administrative fee amount?

The Reliability Assessment is subject to an administrative fee, the amount of which depends on the method of submission.

Fee amount:

  • 5,00 € – electronic submission
  • 10,00 € – submission by post or in person.

The administrative fee can be paid by the eKolok payment system, or bought at a Slovak post office, or paid by payment order (the payment order will be provided to the applicant after officially receiving the application).

6. How to submit an application?

The application for the Reliability Assessment may be submitted in the following ways:

The application may be submitted via www.slovensko.sk. In this case, it must be signed with a qualified electronic signature in accordance with Act No. 215/2002 Coll. on Electronic Signature.

·      In person

The application may be submitted in person at the Filing Department of the Transport Authority. The opening hours of the Filing Department are available here.

 

Important Notes

  • The application must include all required attachments
  • In all documents please fill all mandatory fields marked with *.
  • All dates must be filled in following date format day.month.year (DD.MM.YYYY).
  • In the Record of Employment form, please do not forget to indicate the state of residence, where the applicant has resided during the employment/study and so on.
  • PDF forms can be completed electronically after downloading and saved.
